Overview

Established by Congress in 1961, the Cape Cod National Seashore encompasses roughly 44,000 acres across six Outer Cape towns. However, only about 27,000 acres are owned directly in fee by the federal government; the remaining land consists of municipal holdings and roughly 600 private properties.

The Compact of Cape Cod Conservation Trusts works in tandem with Outer Cape land trusts, town open space committees, and the National Park Service (NPS) to acquire private inholdings, secure conservation restrictions (CRs), and promote the ethic of "living lightly on the land".

Key Conservation Strategies & Case Studies

1. Reserve Life Estates (The Falk Family & Zanadu – Truro)

  • Property: Zanadu, a sprawling estate built in 1956 atop the Pamet River Valley by Lee Falk (creator of The Phantom and Mandrake the Magician).

  • Structure: In collaboration with the Truro Conservation Trust and the NPS, the family arranged a sale to the National Seashore with a reserved life estate, granting exclusive family use for life while ensuring permanent protection from overdevelopment.

2. Conservation Restrictions & Tax Credits (The Watts Property – Wellfleet)

  • Property: A 2-acre forested parcel in Wellfleet owned by artists Peter and Gloria Watts across Pamet Point Road.

  • Structure:

    • 2007: Donated a Conservation Restriction (CR) to the Wellfleet Conservation Trust, receiving a ~90% federal income tax deduction and town property tax reduction based on the lot's reduced house value.

    • 2011: Donated the land outright to the Wellfleet Conservation Trust, becoming one of the first Cape Cod landowners to utilize the Massachusetts state conservation tax credit.
